Implementasi Perundang-Undangan Ketenagakerjaan Terhadap Buruh Pasar Ditinjau Dari Perspektif Keadilan

ABSTRAK
Pertumbuhan pendudukan yang sangat signifikan di Indonesia tidak sejalan dengan penyerapan tenaga keraj di sektor formal, hal ini menyebabkan meningkatnya pencari kerja disektor nonformal yang sering mengacuhkan hak-hak sebagai pekerja. Metode yang digunakan dalam penelitian ini, yaitu yuridis empiris, data penelitian ini diperoleh melalui wawancara, observasi dan dokumentasi. Hasil penelitian menunjukkan bahwa Implementasi perundang-undangan Ketenagakerjaan terhadap buruh pasar tradisional di kota Takengon belum terlaksana dengan maksimal, sosialisasi maupun pendampingan terhadap pekerja belum dirasakan, sehingga prinsip-prinsip keadilan bagi buruh pasar tradisional belum dapat dirasakan Hal ini disebabkan belum termuatnya secara tegas peraturan-peraturan yang melindungi para buruh pasar tradisional dari ancaman kesewenang-wenangan pemberi kerja. Hak-hak buruh pasar tradisional belum dapat diimplementasikan secara baik, karena perjanjian kerja di antara pemberi kerja dan pekerja hanya dilandaskan kepada perjanjian lisan. Sehingga pemberian hak-hak dasar oleh pemberi kerja hanya berlandaskan kekeluargaan.Kata Kunci : Ketenagakerjaan, Persfektif Keadilan
ABSTRACT
The very significant growth of occupation in Indonesia is not in line with the absorption of keraj power in the formal sector, this has led to an increase in job seekers in the informal sector who often ignore the rights of workers. The method used in this study, namely empirical juridical, this research data obtained through interviews, observation and documentation. The result of the research shows that the implementation of labor legislation on traditional market workers in Takengon has not been implemented maximally, socialization and assistance to workers has not been felt, so the principles of justice for traditional market workers have not been felt. regulations that protect traditional market workers from the threat of employer arbitrariness. Traditional market labor rights can not yet be properly implemented, since employment agreements between employers and workers are based solely on oral agreements. So that the granting of basic rights by employers is only based on kinship.Keywords : Employment, Persfective Justice
