Kendala Bank Mandiri Syariah Takengon Dalam Proses Pembiayaan Murabahah

Abstrak
Di Indonesia sendiri perkembangan ekonomi Islam ditandai dengan beroperasinya Bank Muamalat pada tahun 1992, dan mengalami perkembangan yang cukup  pesat  sejak perubahan  Undang-Undang  Nomor  7  Tahun  1992  menjadi Undang-Undang  Nomor  10 Tahun 1998 tentang Perbankan. Diprakarsai oleh Majelis Ulama Indonesia (MUI), Pemerintah Indonesia, serta mendapat dukungan nyata dari eksponen Ikatan Cendekiawan Muslim se-Indonsia (ICMI) dan beberapa pengusaha muslim. Tujuan dilakukan penelitian ini adalah untuk mengetahui bagaimana perkembangan akad pembiayaan murabahah di bank syariah mandiri serta kesesuaiannya dengan prinsip fiqih Islam. Hasil penelitian menunjukkan pembiayaan Murabahah telah mengalami perkembangan sampai pada tingkat yang cukup kompleks. Pembiayaan Murabahah masa ini telah melibatkan 3 (tiga) pihak yaitu pembeli (nasabah), penjual (bank) dan supplier. Untuk implementasi pembiayaan Murabahah di Bank Mandiri Syariah Takengon, setidaknya ada 3 pola pengembangan yang diterapkan. Akad pembiayaan murabahah pada Bank Syariah Mandiri Takengon masih terdapat beberapa aspek yang kurang relevan dengan prinsip-prinsip dasar murabahah dalam fikih Islam.
Abstrac
In Indonesia itself, the development of the Islamic economy was marked by the operation of Bank Muamalat in 1992, and experienced a fairly rapid development since the amendment of Law Number 7 of 1992 to Law Number 10 of 1998 concerning Banking. Initiated by the Indonesian Ulema Council (MUI), the Government of Indonesia, and received real support from exponents of the Indonesian Muslim Intellectuals Association (ICMI) and several Muslim entrepreneurs. The purpose of this research is to determine how the development of the murabahah financing contract in an independent Islamic bank and its compliance with the principles of Islamic fiqh. The results showed that Murabahah financing has developed to a quite complex level. Murabahah financing at this time has involved 3 (three) parties, namely the buyer (customer), seller (bank) and supplier. For the implementation of Murabahah financing at Bank Mandiri Syariah Takengon, there are at least 3 development patterns that are applied. Murabahah financing agreements at Bank Syariah Mandiri Takengon still have several aspects that are less relevant to the basic principles of murabahah in Islamic jurisprudence.
